These Terms of Service (“Terms”) govern your access to and use of ABASmart. By creating an account, accessing, or using our services, you agree to be bound by these Terms.

1) Accounts & Access

You must be at least 16 years old (or the age required by your local law) and have authority to accept these Terms. You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your credentials.

You must promptly notify us of any unauthorized use of your account. We may suspend access if we detect suspicious activity.

2) Acceptable Use

You agree not to misuse the services, including (without limitation): attempting to access data you don’t own, reverse engineering, disrupting availability, introducing malware, infringing IP rights, or breaking applicable laws and regulations.

We reserve the right to investigate and suspend or terminate accounts that violate these Terms.

3) Subscriptions & Payments

If your plan requires payment, fees are billed in advance on a recurring basis unless stated otherwise. Taxes may apply. You can cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

Paid features may be suspended for non-payment. Refunds are handled per our refund policy, where applicable.

4) Intellectual Property

ABASmart and its content, features, and functionality are and will remain the exclusive property of their respective owners. You may not use our trademarks, logos, or branding without written permission.

Content you upload remains yours. You grant ABASmart the limited rights necessary to operate the service (e.g., processing and storing your data to provide features).

5) Privacy

Our processing of personal data is described in the Cookie Policy and our privacy practices documentation. By using the service, you consent to such processing as described there.

6) Security

We implement reasonable technical and organizational measures to protect your data. However, no method of transmission or storage is 100% secure. You are responsible for securing your account and devices.

7) Warranty Disclaimer & Liability

The service is provided “as is” and “as available” without warranties of any kind unless required by law. To the maximum extent permitted, ABASmart shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill.

8) Termination

You may stop using the service at any time. We may suspend or terminate access for conduct that violates these Terms or poses risk to the service or other users.

9) Governing Law & Disputes

These Terms are governed by the laws applicable in your country of residence or, if agreed in writing, by the laws of Spain. Courts in Madrid shall have non-exclusive jurisdiction, without prejudice to mandatory protections under consumer law.

10) Changes to the Terms

We may revise these Terms from time to time. We will post updates here and, when appropriate, notify you by email or in-app. Continued use after changes means you accept the revised Terms.
